These General Terms and Conditions (“GTC”) govern the relationship between waermepumpen-guide.ch and individuals or companies submitting a request via the portal (“Interested Parties”).
1. Scope of application
1.1. The version of these Terms and Conditions published at the time of the request applies. Deviating terms from interested parties or specialist installers only become effective if waermepumpen-guide.ch explicitly agrees to them.
1.2. The offer is exclusively directed at interested parties with a project location in Switzerland.
2. Request and confirmation
2.1. By submitting the form, interested parties instruct waermepumpen-guide.ch to record, review and process their request for referral to suitable specialist installers. The request is free of charge and non-binding for interested parties. Any remuneration for the referral service is provided by the specialist installers.
2.2. Depending on the request process, the specified email address or the request must be confirmed via a sent link. Without the required confirmation, the request cannot be processed further.
2.3. Until the form is submitted, entries can be changed or the process aborted. After submission, corrections can be communicated via anfrage@waermepumpen-guide.ch.
3. Selection and forwarding to specialist installers
3.1. waermepumpen-guide.ch matches the details, in particular based on project type, region, availability and service profile, with suitable specialist installers in the partner network. A request can be forwarded to up to three matching specialist installers.
3.2. The specialist installers introduced may contact interested parties by email or telephone, request additional project details and, if necessary, arrange an appointment or an on-site inspection.
3.3. waermepumpen-guide.ch does not provide technical planning, energy consulting, product advice or installation services. The professional review, advice, quoting and execution are the sole responsibility of the respective specialist installer.
4. Quotes and contract with a specialist installer
4.1. There is no entitlement to a specific number of contacts or quotes. Whether and when a specialist installer prepares a quote depends, among other things, on the project, region, capacity and a possible on-site assessment.
4.2. Interested parties decide for themselves whether and from which specialist installer they accept a quote. A contract for consulting, delivery, installation or other services is concluded exclusively between the interested parties and the chosen specialist installer.
4.3. waermepumpen-guide.ch is neither a contracting party nor a representative or agent for performance of the specialist installer. The respective specialist installer is responsible for the content, prices, completeness and execution of the quotes or services.
5. Obligations of interested parties
5.1. Information must be truthful, current and complete. Requests may only be submitted for your own projects or with appropriate authority to act on another party's behalf.
5.2. Natural persons must be of legal age and have full legal capacity. Anyone acting on behalf of a company or other organisation confirms the necessary authorisation for this.
6. Availability and limitation of liability
6.1. waermepumpen-guide.ch strives for reliable operation and appropriate matching, but does not guarantee the uninterrupted availability of the portal, the finding of a specialist installer, the receipt of a quote, or the conclusion of a contract.
6.2. To the extent permitted by law, waermepumpen-guide.ch is not liable for services, statements, quotes or damages attributable to an independent specialist installer. Mandatory statutory liability provisions remain reserved.
7. Data protection
7.1. For processing and forwarding the request, personal data is processed and passed on to up to three suitable specialist installers. Details are described in the privacy policy.
8. Termination and revocation of the request
8.1. Interested parties may inform waermepumpen-guide.ch at any time that their request should not be further processed or referred to additional specialist installers. The notification must be sent to anfrage@waermepumpen-guide.ch. Any referrals already made are unaffected; a corresponding request must additionally be communicated directly to specialist installers who have already been contacted.
9. Final provisions
9.1. Should a provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
9.2. Unless mandatory law provides otherwise, Swiss law applies.
